1. Scope and Organiser
These General Terms and Conditions apply to all giveaways and competitions organised by:

This includes giveaways and competitions conducted through the company’s websites, social media channels, newsletters, printed materials or events.
The information published with each individual giveaway, particularly the prize, entry period, entry method and eligible territory, forms part of these Terms and Conditions. In the event of any conflict, the conditions stated in the individual giveaway announcement shall take precedence.
If a giveaway is organised together with a cooperation partner, the relevant partner will be named in the individual announcement.
2. Eligibility
The giveaway is open to individuals who are at least 18 years old at the time of entry and reside within the eligible territory specified in the individual giveaway announcement.
Employees of Koch alpin GmbH and anyone directly involved in the planning or administration of the giveaway are not eligible to participate.
Unless expressly stated otherwise, entry is free of charge and no purchase is necessary. Any costs incurred for internet access, postage or other communication services used to enter will not be reimbursed.
3. Entry Period and Method
The starting and closing dates, as well as the actions required to enter, will be stated in the individual giveaway announcement.
For social media giveaways, entry may require participants to comment, like, follow, share or complete another action described in the relevant post. For giveaways conducted through printed materials or at events, the entry instructions provided there shall apply.
Entries must be received within the stated entry period. Entries received after the closing date will not be considered.
Unless otherwise stated, only one entry per person is permitted.
4. Exclusion from Participation
Koch alpin GmbH reserves the right to exclude participants for objectively justified reasons, particularly in the event of:

false or misleading information,

multiple entries contrary to the applicable conditions,

automated or manipulated entries,
-
a breach of these Terms and Conditions,

unlawful, offensive or discriminatory content,

an infringement of third-party rights, or
-
any other unfair conduct.
In such cases, a prize that has already been awarded may be withdrawn and awarded to another participant.
5. Winner Selection and Notification
The method of winner selection will be stated in the individual giveaway announcement. Unless another selection method is specified, the winner will be selected at random from all valid entries.
Winners will be contacted using the communication method associated with their entry, such as a direct message, comment, email, telephone call or post.
If a winner does not respond within seven days of being notified, their claim to the prize may expire and another winner may be selected. A different response period may be specified in the individual giveaway announcement.
Winners must provide complete and accurate contact details for the delivery of the prize. Names or social media usernames will only be announced publicly if this was stated in the giveaway announcement or the winner has provided their consent.
6. Prizes and Prize Delivery
The type and scope of the prize are described in the individual giveaway announcement. Product images are for illustrative purposes and the actual prize may differ.
Unless otherwise stated, prizes cannot be exchanged, transferred to another person or redeemed for cash.
The prize will be delivered or handed over as described in the giveaway announcement. If delivery is not possible due to incorrect or incomplete information provided by the winner, the prize may be awarded to another participant.
Any additional costs not expressly included in the prize will not be covered. Travel, event or experience prizes may also be subject to the terms and conditions of the relevant provider.
7. Changes or Cancellation
Koch alpin GmbH reserves the right to modify, suspend or cancel a giveaway for good cause. This may apply in particular if proper administration can no longer be guaranteed due to technical problems, manipulation, legal reasons, force majeure or other circumstances beyond the organiser’s reasonable control.
Any rights already acquired by participants and any mandatory statutory rights remain unaffected.
8. Social Media Giveaways
Giveaways hosted on Instagram, Facebook, TikTok, YouTube or other social media platforms are not affiliated with, sponsored, endorsed or administered by the respective platform operators unless expressly stated otherwise.
The organiser and recipient of the information provided by participants is Koch alpin GmbH or a cooperation partner expressly named in the individual giveaway announcement.
To the extent permitted by law, participants release the respective social media platform from any claims arising in connection with the giveaway. The terms of use and policies of the respective platform also apply.
9. Submitted Content and Third-Party Rights
If participants submit photographs, videos, texts or other content, they confirm that they hold all necessary rights and that the publication of the content does not infringe any third-party rights.
Any identifiable persons featured in submitted content must have consented to the recording and intended use. Unlawful, offensive, discriminatory or otherwise inappropriate content will be excluded.
To the extent necessary to administer and communicate the giveaway, participants grant Koch alpin GmbH a non-exclusive and royalty-free right to publish and share the submitted content through its own communication channels in connection with the giveaway. Any further promotional use requires a separate agreement or consent.
10. Data Protection
Personal data collected in connection with a giveaway will only be processed for the purpose of administering and completing the giveaway. This may include the participant’s name, social media username, contact details, postal address and submitted content.
The processing is based on Article 6(1)(b) GDPR for the administration of the giveaway. Where necessary, data may also be processed under Article 6(1)(f) GDPR for the prevention of misuse or the establishment, exercise or defence of legal claims.
Winner information may be shared with shipping providers or a cooperation partner expressly named in the giveaway announcement where this is necessary to deliver the prize.
Personal data will only be used for promotional purposes or newsletter subscriptions on the basis of separate and voluntary consent. Such consent may be withdrawn at any time with effect for the future and has no influence on participation in the giveaway.
Personal data will be deleted once the giveaway has been completed and the data is no longer required for its administration, unless statutory retention obligations or legitimate interests require otherwise.
11. Liability
The liability of Koch alpin GmbH is governed by the applicable statutory provisions.
Koch alpin GmbH accepts no responsibility for technical problems, communication network failures or issues affecting the relevant social media platform where these circumstances are beyond its reasonable control.
Koch alpin GmbH is not responsible for damage caused by the improper use of a prize. Mandatory statutory claims, particularly those relating to product liability or injury to life, body or health, remain unaffected.
12. Applicable Law
These Terms and Conditions are governed by Austrian law, excluding its conflict-of-law provisions.
Mandatory consumer protection provisions of the country in which a participant has their habitual residence remain unaffected. The statutory places of jurisdiction apply.
